Terms of Service

1. Acceptance

By accessing or using NetScout Cloud ("the Service") you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

NetScout Cloud is a network monitoring and security platform that collects telemetry from a locally installed agent and presents it through a hosted web interface. The Service includes device discovery, threat detection (NIDS/HIDS), user-experience path measurement, and administrative dashboards.

3. Accounts and Access

• You must provide a valid email address and keep your credentials confidential.
• Trial accounts are valid for 7 days from the date of registration. Data collected during the trial period is retained for the duration of the subscription after upgrade.
• You are responsible for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

• Use the Service to monitor networks or devices you do not own or have explicit written permission to monitor.
• Attempt to reverse-engineer, decompile, or circumvent any security measures of the Service.
• Resell or sublicense access to the Service without prior written consent.
• Transmit malware, spam, or any content that violates applicable law.

5. Data Ownership

All network telemetry (device records, NIDS/HIDS events, path probes, etc.) collected by your agent belongs to you. We process it solely to provide the Service. See our Privacy Policy for full details.

6. Service Availability

We target 99.5 % monthly uptime for the hosted gateway and dashboard. Planned maintenance will be announced via email where possible. We are not liable for outages caused by third-party infrastructure (Render, Supabase, Cloudflare) or force-majeure events.

7. Limitation of Liability

The Service is provided "as is". To the maximum extent permitted by law, Incytes Inc. shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

8. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance. Material changes will be communicated by email.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles.
